In your biased opinion, it is clearly Discrimination
“That’s Discrimination;
I wasn’t picked because……” At some point in our lives, we have all been
there. Depending on our personal
situation, some of us will go there more often than others. It is most prevalent in schools,
competitions, and job interviews.
Someone else gets selected for an assignment that you know is less
qualified than you. You know without a
doubt that in your “biased opinion” it is clearly discrimination against
you. In fact, it may be true that you
were discriminated against; it might also be true that it was for legitimate
reasons. I am not referring to
discrimination prohibited by law, including: Age, Disability, Equal Pay/Compensation,
Genetic Information, Harassment, National Origin, Pregnancy, Race/Color,
Religion, Retaliation, Sex, and Sexual Harassment. To find out more about discriminations that

. Having said that, just because you
labeled it as an EEOC listed discrimination, doesn’t always mean it was really
was. Therefore, from here on out, when I
say “discrimination”, I am only referring to legal discriminatory practices
that employers utilize every day.
Legal Discrimination
You might ask, “How can I be
legally discriminated against?” It actually
happens so much that we don’t even think of it as discrimination. Any selection process which uses one trait or
perceived category as a factor in the decision process is discriminating
against that group. To give an example: an employer can discriminate against
everyone that submits an application or resume with spelling errors. There is nothing prohibiting them from
categorizing individuals that make careless application errors with individuals
that make careless work errors. Despite
the fact that a spelling error does not always equates to someone who will make
careless work errors. It could have
nothing to do with work ethics, just the fact that they learned English in
Europe where “color” is spelled “colour”. Nevertheless, this form of discrimination
is actively used under the description of “screening” because it sounds better
than discrimination. So what can be
done? Since these discriminators are
not against fixed factors like Race, Sex, Age, etc; you need to identify them
and take the appropriate steps to not be part of the discriminated group. Some of the more common groups are;
Avoiding Discriminatory Screening Tools
- Attention to detail. Let us start right off with the brass tacks. You are submitting a job application for a very self centered reason of self improvement, regardless if it is for reasons of finance or status. Employers have a discriminatory prejudice belief that there is a direct correlation between the effort you put into increasing your profits and the effort you will put into increasing corporate profits. Therefore you want to make sure your application is picture perfect. Since there are numerous excellent resources on the web on how to prevent this, I will move to the next one.
- Attitude is everything. The majority of our wake hours will be spent with the people at work. Your personality can be like the morning sunlight that brings new life to the office or a leaking vat of toxin botulinum that will kill the office atmosphere faster than an A-bomb dropped on Hiroshima. The HR office will blatantly discriminate against anyone that uses negative terminology on their application like they have the black plague. This is very difficult to avoid because job searching can become a depressing task that will bring down the most optimistic of individuals. It is very easy to have this depressed attitude slip into the message you sending in your cover letter and resume. You really need to have someone with a positive attitude proof read your application to make sure you are not putting a negative spin on your message.
- Flexibility to change. It is real easy to assume discrimination was a prohibited category when in fact it was this legal one. This can be especially true for individuals who have been hearing, “you’re over qualified.” A lot of employers will avoid someone with credentials that exceed the job requirements because they think you will leave before they are compensated the cost involved with training you. On the other hand, employers will also tell this to knowledgeable candidates that appear to be stuck in a fixed pattern. They know successful new employees have to make a lot of changes to adjust to the company’s environment. If you are not willing to assimilate into their environment, then all of their employees will have to disrupt their work cycles to accommodate your social needs. The simplest way to show your flexibility is to complete an academic course. It is the easiest way to show you are open to new ideas. You don’t have to pay for a college degree to do this. There are sites like New York’s Green Cleaning Program at https://greencleaning.ny.gov/entry.asp that provides certificate of trainings for modern custodial cleaning methods. There are also web sites dedicated to paid and free online courses that provide completion certificates. - Political Views. This should be self explanatory. Unless you are applying for a political job, keep your party affiliation and views to yourself.
- Unemployment. It can seem unfair that an employer can assume that there is a negative reason you are not employed and does not want to find out what it is by adding you to their team. There are a few things you can do to minimize this discrimination. If you are still employed, then stick it out until you land your next job. You are more attractive to potential employers if you are employed. If you are unemployed, you can use only the year of your end date on your resume. That will hide your actual end date and make it seem more recent. You can also join a special interest volunteer group. Not only will you be expanding your network, you will be able to show current employment while job searching. This works, because work listed on the resume does not have to be paid work. Finally, maximize your Linkedin network to find contacts you know that work for the employer. 80% of everyone employed, was hired because they knew someone that helped them with the placement. This is can also be true for you, if you know someone that already works where you are applying.
- Online presence. Without a question, they are going to Google search you. They may even pay a professional who can dig deeper than the Google search engine about you. First step to avoiding this is by not putting anything online that would hurt your employment opportunities. I have a poster at my desk for my customers that shows and employer laughing while stating the fact they had no chance of getting hired after they saw their Facebook page. Next, make sure your settings prevent anyone else from tagging or posting to your account without your approval. Finally, get proactive about making a positive image online image. Use a professional photo on your accounts. Participate in groups related to your employment field. Make sure your Linkedin has an updated resume. At the end of the day, make sure that your name search finds the links that sell you in a positive manner.
